What is a 941 Form?

With a few exceptions, most businesses are required to submit Form 941 on a quarterly basis. For the quarters they are operating, seasonal enterprises only need to file. Businesses that employ farm laborers or household employees like maids are likewise exempt from submitting Form 941, but they must still submit Schedule H from Form 1040. Also, you must submit Form 944 if your business pays less than $1,000 in employment tax in a given tax year.

When would you need to file a 941?

  • You must submit this form if you paid wages, received tip reports from your staff, or withheld federal income tax, social security tax, or Medicare tax.
  • Even if you have no taxes to declare, you must still file a return if you submitted a Form 941 for the previous quarter. This has a lot of exceptions.

What do you need to report on Form 941?

For the purpose of reporting federal withholdings from employees, businesses must complete Form 941. Wages, reported tips from employees, federal income tax withholdings, employer and employee contributions to Social Security and Medicare taxes, and further Medicare tax withholdings are all included in this. For things like sick pay or tips, you might also need to include quarterly increases to Social Security or Medicare taxes.

You will need to pay a total amount of money to meet your payroll tax responsibilities for the quarter after taking these items into account.

Who needs to file Form 941?

Not every employer needs to submit a Form 941. It’s almost guaranteed that an employer must submit a Form 941 if they provided employees with wages that were subject to Social Security, Medicare, and income tax withholding on a federal level. If the employer received a notice to file Form 944, Employer’s Annual Federal Tax Return, that would be an exemption. Usually, small employers with little tax liabilities use this form. For the quarters in which they have no tax liability, seasonal employers are not required to file a Form 941. Employers of farm typically file Form 943, Employer’s Annual Federal Tax Return for Agricultural Employees, instead of Form 941, which is typically used by employers of domestic employees.  The IRS points out that even if the employer didn’t pay wages during the quarter, the business must still file a Form 941 if none of these exceptions apply and a final return hasn’t been completed.

Where should you file Form 941?

Businesses are encouraged to file Form 941 online. The address will change depending on where the employer is located if filing by mail, though. To avoid sending a form to the wrong place, a multi-state company will want to pay special attention to these addresses. If the employer sends Form 941 with or without a payment, the address will also change.
